1. Who you are dealing with
The website and community are operated by Mark Jarvis MRJ, trading as Tennis Creators, ul. Fabryczna 14d, 53-609 Wrocław, Poland (NIP 7532455176), referred to as "we", "us" or "our". By using the site or joining the community you agree to these terms. Nothing in them affects the statutory rights you have as a consumer under the mandatory consumer protection laws of your country of residence, including the Consumer Rights Act 2015 if you live in the UK.
2. Accounts
You must give accurate information when creating an account and keep your login details safe. You are responsible for activity under your account. You must be at least 16 to hold your own account; younger players take part through spaces managed with a parent or guardian.
3. Memberships, payments and renewal
Paid memberships and purchases are billed through Stripe at the prices shown at checkout, including any applicable VAT. Subscriptions renew automatically until cancelled; you can cancel any time from your billing settings and keep access until the end of the paid period. We will tell you in advance about any price change, and you can cancel before it takes effect.
4. Your cooling-off right
If you are a consumer in the UK or the EU you have a 14-day cancellation right for distance contracts under the Consumer Contracts Regulations 2013 and the Consumer Rights Directive 2011/83/EU. For memberships, if you ask us to start the service during those 14 days and then cancel, we refund the price minus a proportionate amount for the period you had access. For digital content supplied immediately (such as unlocking a course), you consent at checkout to immediate supply and acknowledge that this ends the cooling-off right for that content, as the regulations provide. To cancel, use your billing settings or contact mark@tenniscreators.com.
5. Your content
You keep ownership of what you post. You grant us a non-exclusive licence to host, display and distribute your content within the service so the community can function. You must have the rights to anything you upload. The licence ends when you delete the content or close your account, except for copies kept in backups for a limited period or where the law requires retention.
6. Acceptable use
- No unlawful, abusive, hateful or harassing content or behaviour.
- No spam, scraping, or attempts to break or overload the service.
- No sharing of paid content outside the community without permission.
- Coaching guidance is general information, not medical advice; train sensibly.
We may remove content or suspend accounts that break these rules, acting reasonably and, where practical, with notice and a chance to respond.
7. Our content
Courses, videos, the Training Deck and other materials are owned by us or our licensors and are for your personal, non-commercial use. Do not copy, resell or redistribute them.
8. Liability
We provide the service with reasonable skill and care. Nothing in these terms excludes or limits liability that cannot lawfully be excluded: death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights. Subject to that, we are not liable for losses that were not foreseeable when you agreed to these terms, and our total liability is limited to the greater of the amounts you paid us in the 12 months before the claim and 50 GBP.
9. Ending the agreement
You can close your account at any time. We can suspend or terminate accounts for breach of these terms, with notice where reasonable. On termination, sections that by their nature should survive (content licences for backups, liability, governing law) survive.
10. Changes to these terms
We may update these terms; significant changes will be announced before they take effect, and if you do not accept them you can cancel before they apply. Continued use after that means you accept the updated terms.
11. Governing law and disputes
These terms are governed by the laws of Poland. If you are a consumer, you also benefit from the mandatory provisions of the law of your country of residence, including UK law if you live in the UK, and you may bring proceedings in the courts of the country where you live.
